Hidden Assets Abroad: How International Law Tracks and Recovers Concealed Patrimony

“The border does not erase the debt. With the right instruments, patrimony hidden abroad finds those who seek it.”

You have a receivable. You pursued the debtor. You won in court.

And then discovered that there are no assets in Brazil. Or worse: the debtor transferred everything abroad before the judgment.

This situation is more common than most people realize. And there is a legal response to it.

🔍 Available Instruments for Tracking and Recovery

InstrumentHow It Works
International asset tracingPatrimonial intelligence tools identify accounts, properties, and corporate holdings in foreign jurisdictions
International legal cooperationBrazilian judgments can be enforced in countries with bilateral agreements
Letters rogatoryFormal mechanism between judiciaries to request freezing orders and information abroad
MLAT (USA)When financial crime is suspected, U.S. authorities can be engaged via Mutual Legal Assistance Treaty
Piercing the corporate veilDebtors who conceal assets via offshore companies are exposed through corporate network analysis

⚠️ What Constitutes Fraud Against Enforcement?

When a debtor transfers assets abroad after proceedings begin or to defraud creditors, this constitutes:

📌 Fraud against enforcement — acts void as against the creditor (CPC, Art. 792) 📌 Fraud against creditors — voidable via Paulian action (Civil Code, Arts. 158 et seq.) 📌 Possible criminal liability under Art. 179 of the Brazilian Penal Code

💡 What Should the Creditor Do?

✅ Act quickly: the sooner the patrimony is identified, the lower the chance of further asset transfers.

✅ Engage patrimonial intelligence: attorney + international financial consulting is the standard for these cases.

✅ Assess economic viability: in smaller credits, the cost of international pursuit may exceed the recoverable amount. Strategic analysis precedes action.

✅ Document everything: statements, transfers, deeds — any evidence of fraudulent transfer strengthens your position.

🌐 Where Is Tracing Most Effective?

Jurisdictions with stronger cooperation and transparency:

  • 🇺🇸 United States (FinCEN, MLAT)
  • 🇵🇹 Portugal and EU bloc (BEPS, CRS, UBO registries)
  • 🇬🇧 United Kingdom (beneficial ownership register)

Jurisdictions with greater resistance (but not impossible):

  • Cayman, BVI, Panama, UAE — require more sophisticated instruments
